WAIVER, RELEASE OF LIABILITY & ACKNOWLEDGMENT OF RISK

IMPORTANT — PLEASE READ CAREFULLY

This document affects legal rights. Firearms training and related activities involve inherent risks that may result in serious bodily injury, death, or property damage.

Please read this entire document carefully before signing. If you do not understand any provision, do not sign until you have had an opportunity to ask questions or seek independent legal advice.

ACKNOWLEDGMENT & ASSUMPTION OF RISK

I understand that participation in firearms training, shooting activities, and related instruction involves inherent and other risks. I voluntarily choose to participate with knowledge of these risks and acknowledge the following:

1. Firearms and Ammunition Risks

I understand that firearms and ammunition are inherently dangerous and that their possession, handling, loading, unloading, firing, transportation, and use can result in serious bodily injury, permanent disability, death, or property damage. These risks may exist even when appropriate safety rules and procedures are followed.

2. Live-Fire and Range Risks

I understand that live-fire training and shooting-range activities may expose me to risks including, but not limited to, firearm discharge, accidental or unintended discharge, ricochets, bullet or projectile fragments, flying debris, hot cartridge cases, firearm or ammunition malfunctions, noise, and the actions or mistakes of other participants or persons at the training location.

3. Hearing, Vision, and Environmental Risks

I understand that firearms training may expose me to extremely loud noise, airborne particles, smoke, lead or other substances associated with firearms and ammunition, weather conditions, uneven or slippery surfaces, heat, cold, and other environmental conditions. I understand the importance of using appropriate eye and hearing protection and following applicable safety procedures.

4. Physical Activity and Equipment Risks

I understand that training may involve standing, walking, movement, kneeling, positional shooting, drawing or manipulating equipment, repetitive movements, and other physical activity. I understand that firearms, holsters, ammunition, targets, range equipment, and other training equipment may create additional risks of injury or property damage.

5. Voluntary Assumption of Risk

I knowingly and voluntarily choose to participate in the applicable Argus Tactical LLC training activities. I understand and voluntarily assume the inherent and reasonably foreseeable risks associated with my participation, including the risk of serious bodily injury, permanent disability, death, and property damage, except to the extent that a risk or liability cannot lawfully be assumed or waived under applicable law.

RELEASE, RESPONSIBILITY & LIMITATIONS

1. PARTICIPANT RESPONSIBILITY

I accept responsibility for my own conduct during training and agree to follow all instructor commands, safety rules, range rules, and applicable laws. I understand that I am responsible for injuries, losses, or damages resulting from my own intentional, reckless, negligent, or otherwise wrongful conduct, to the extent permitted by applicable law.

2. INHERENT RISKS

I knowingly and voluntarily accept the inherent risks associated with firearms training and shooting activities as described in this agreement. I understand that some risks cannot be completely eliminated even when reasonable safety precautions are taken.

3. CLAIMS ARISING FROM OTHER PERSONS OR CONDITIONS

To the fullest extent permitted by applicable law, I accept the risks arising from the conduct of other participants, range users, spectators, or other third parties, as well as risks arising from conditions inherent in or ordinarily associated with firearms training and shooting activities.

4. LIMITATION OF THIS AGREEMENT

I understand that nothing in this agreement is intended to waive, release, or limit any right or claim that cannot lawfully be waived, released, or limited under Virginia law. I further understand that this agreement does not release Argus Tactical LLC or any other person or entity from liability for future negligence causing personal injury where such a release is prohibited by applicable law.

EQUIPMENT, PHYSICAL CONDITION & EMERGENCY RESPONSE

1. Firearms, Ammunition & Equipment

If I bring or use my own firearm, ammunition, holster, protective equipment, or other equipment during training, I am responsible for ensuring that it is appropriate for the training activity and, to the best of my knowledge, is in safe working condition. I understand that Argus Tactical LLC may inspect, restrict, or prohibit the use of equipment that an instructor reasonably determines is unsafe, unsuitable for the training activity, inconsistent with range requirements, or otherwise inappropriate for use during the course.

2. Eye & Hearing Protection

I understand that appropriate eye and hearing protection must be worn whenever required by Argus Tactical LLC, the instructor, or the training facility. I agree to properly use required protective equipment and understand that failure to do so may result in my removal from the applicable training activity.

3. Physical Ability & Participation

I understand that some training activities may involve physical movement, prolonged standing, kneeling, positional shooting, repetitive movements, exposure to outdoor conditions, or other physical demands. I accept responsibility for determining whether I can safely participate in a particular activity and agree to notify the instructor if I need to stop or modify my participation.

I understand that I am not required by this form to disclose a diagnosis, disability, medication, or other private medical information unless I voluntarily choose to provide information relevant to requesting an accommodation or addressing an immediate safety concern.

4. Alcohol, Drugs & Impairment

I agree that I will not possess, handle, or use a firearm or participate in live-fire activities while impaired by alcohol, unlawful drugs, medication, fatigue, illness, or any other condition that makes firearm handling unsafe. I understand that Argus Tactical LLC may restrict or terminate my participation if an instructor reasonably determines that I appear unable to participate safely.

5. Emergency Response

In the event of an apparent medical or safety emergency during training, I authorize Argus Tactical LLC personnel to contact emergency medical services, law enforcement, range personnel, or other appropriate emergency responders when reasonably believed necessary. I understand that Argus Tactical LLC does not guarantee the availability, timing, or outcome of emergency services.

Emergency Contact

PROPERTY & PERSONAL RESPONSIBILITY

1. PERSONAL PROPERTY

I understand that I am responsible for securing and maintaining control of my firearms, ammunition, equipment, and other personal property before, during, and after training, except when an instructor specifically directs otherwise for a training activity. I understand that Argus Tactical LLC is not responsible for loss, theft, or damage to personal property except to the extent responsibility cannot lawfully be excluded or limited.

2. DAMAGE CAUSED BY PARTICIPANT

I accept responsibility, to the extent permitted by applicable law, for property damage or other loss directly resulting from my intentional, reckless, negligent, or otherwise wrongful conduct during training.

FINAL PARTICIPANT ACKNOWLEDGMENT

By signing below, I acknowledge that I have carefully read this Waiver, Release of Liability & Acknowledgment of Risk in its entirety and understand its contents.

I understand the nature of the firearms-training activities in which I have chosen to participate and acknowledge that these activities involve inherent and other risks, including the possibility of serious bodily injury, permanent disability, death, and property damage.

I voluntarily choose to participate with knowledge of those risks and accept the risks described in this agreement to the extent permitted by applicable law.

I certify that I have had the opportunity to ask questions regarding this agreement before signing it and that I am signing it voluntarily.

I understand that this agreement does not waive or release any claim or legal right that cannot lawfully be waived or released under applicable Virginia law.

I understand that this agreement applies to the Argus Tactical LLC training identified in this submission and that I remain responsible for complying with instructor commands, safety requirements, range rules, and applicable law throughout my participation.
